According to the U.S. Copyright Office, a copyright is a “form of protection provided by the laws of the United States (title 17, U. S. Code) to the authors of ‘original works of authorship,’ including literary, dramatic, musical, artistic, and certain other intellectual works. This protection is available to both published and unpublished works.”
In order to comply with copyright laws and protect the interests of clients, EM requires a Work for Hire or a Copyright Assignment agreement for derivative, compilation or “original work (s) of authorship” created by EM account managers during marketing strategy, business communications and intellectual capital creation projects. Failure to obtain a signed original of either document means that client acknowledges that creative works remain the property of EPiC Measures and may be recycled at will.
Although referrals to legal service professionals may be provided, clients are responsible for obtaining either agreement plus related legal counsel (how intellectual property laws affect the creative process).
